All switchblades are legal to own in my state of California, but the blade must be under 2" long to be legal to carry. So the knife pictured would be legal to both own and carry in California. But of course under the Federal Switchblade Act it is illegal to ship or transport any and all switchblades...

I can't tell how much higher your button is above the scale, but it looks like a very close fit. You might have to enlarge the hole a little. From the pics it looks like that handle shows no sign of age, no splitting, no cracks. Unless it receives regular care, wood suffers from time and age, it dries out, shrinks, cracks, etc.

I'd say there's no way that handle is Cival War era.
